PUBLICATION AGREEMENT
between the Fulda University of Applied Sciences (ROR ID: https://ror.org/041bz9r75), Leipziger Straße 123, 36037 Fulda, represented by the President, Prof. Dr. Karim Khakzar, hereinafter referred to as HFD, the Fulda University and State and Public Library, represented by the Director, Mr. Berthold Weiß, hereinafter referred to as HLSB and the author/rights holder(s).
The subject of the agreement is the materials to be published on the FULDAER DOKUMENTENSERVER – FULDOK. The contract is considered to have been concluded after the publication agreement has been accepted and the materials have been transmitted electronically.
1. GRANT OF RIGHTS
I hereby grant the HFD and the HLSB the non-exclusive right of use to the materials.
The right of use includes the right to use and reproduce the digital object as a whole or in part and to
- make it publicly available for download worldwide in data networks, including by third parties, regardless of the transmission technology,
- permanently store and archive it in electronic databases.
The metadata including the abstract of the document is available free of charge under the terms of CC0 1.0 Universal (CC0 1.0) Public Domain Dedication http://creativecommons.org/publicdomain/zero/1.0/.
The license conditions agreed in the upload process must be observed.
2. RIGHTS OF THIRD PARTIES
I assure that the provision of the digital object, including all components (e.g. illustrations) and, if applicable, additional material, does not violate the rights of third parties (e.g. co-authors, rights holders, publishers, collecting societies, third-party funders) (e.g. copyrights, data protection).
I indemnify HFD and HLSB against all claims that third parties may assert against them on the basis of rights to which they are entitled, insofar as I am responsible for this (including costs of legal prosecution).
If several people are involved in the creation of a digital object, electronic publication can only take place with the consent of all co-authors/co-rights holders.
I assure that I have been granted all necessary rights by all co-authors/co-rights holders and that no rights of third parties are violated by them.
3. TRANSFER OF RIGHTS TO THIRD PARTIES
HFD and HLSB may transfer the rights granted by this contract in whole or in part to third parties and grant or permit other rights of use (e.g. in order to be able to make use of third-party services for the above-mentioned purposes, within the framework of national collection orders, for the purpose of scientific networking or long-term archiving, or if another institution permanently takes over tasks for HFD and/or HLSB).
Within the framework of the obligation to deliver online publications to the German National Library (DNB), the HFD and the HLSB are granted the right to deliver electronic dissertations there or to make them available for collection by the DNB.
A separate consent is not required for this.
4. LONG-TERM ARCHIVING
I grant HFD and HLSB the right to store the documents provided and the associated metadata, the abstract and, if applicable, additional material in their long-term archive and, if necessary, to transfer them to other electronic and physical formats (e.g. migration, accessibility or better accessibility).
5. BLOCKING (TERMINATION IS NOT PROVIDED)
HFD and HLSB are entitled to block access to a document if there are concrete indications of a violation of the rights of third parties. The Contracting Parties undertake to inform each other immediately if third parties assert claims against them on the basis of rights to which they are entitled.
6. HANDLING OF PERSONAL DATA
I acknowledge that, as the publisher of a document on FulDok, I am responsible for ensuring that my document only contains personal data of third parties for which there is a corresponding legal basis (e.g. examination regulations, legal requirements, consent).
CASE: SUBMISSION OF AN ELECTRONIC DISSERTATION
If the material to be published is my own dissertation, I assure you that the version of the work provided to the HLSB is completely identical to the version submitted in the doctoral procedure. If the version of the work provided to the HLSB does not fully correspond to the version submitted in the examination procedure, I assure you that the deviations have been approved by the examination body responsible for conducting the examination. If it is a cumulative dissertation, I am aware that parts that have already been published may only be posted with the permission of the publishers.
